FYI
Feel free to learn from this information or use it in contract disputes where it may apply.
I was at home, minding my own business when I received a phone call asking if I would like to call a special dance
on Friday for the Arkansas State Federation, and they asked what I would charge.
I told them that I would love to call the dance, that I had friends in the area and would attempt to book a "tour"
through their area. I told them that I did not need a lot of money for this dance, I hated to give him a figure that
would turn them off, as long as I could enjoy the trip without loosing money I would be happy.
I was offered $800 plus a room and I accepted it. This was more than I had considered, but I am aware that it was
less than some others might ask for this event. This is a hobby for me.
(8/12/07) I received a "Arkansas State Square Dance Federation, Inc. contract. (Notice My Phone Number at the
top and the paragraph concerning cancellation near the bottom.)
(4/7/08) I received the attached letter stating that the Arkansas State Square Dance Federation, Inc. was
unilaterally cancelling our contract without any discussion with me. The reason given was the anticipated drop in
attendance would not cover my fee. I was not given the courtesy of stepping down, or adjusting their offered fee.
(7/25/08) I received a letter (by certified mail, a good touch) asking that I call them to acknowledge that I had
received the cancellation (included). I have made a couple of calls but did not reach Art. I believed that, per their
own contract, they should have been contacting me before any attempt was made to fire me and hire another
caller. I really had no problem with "not" doing this dance. It was a long trip and I could earn more running my
"real" business in NC. All I expected was for them to honor their contract and discuss the cancellation with me.
I have patiently waited to see who would be calling this event. Recently I found a notice on the Internet that Gary
Shoemake would be doing this dance. (Link Included) I have no problem with Gary doing this dance, Gary is
better known than me, heck he may even be a better caller. My question is, "Why was I fired - through the mail?"
I do not know why this was handled this way, but sadly I think it would benefit all involved if the members of the
Arkansas State Square Dance Federation, Inc. was aware of the way their organization conducted business in this
case.
